There was a Settlement Conference scheduled for October 6, 2010 at 10:30 a.m. regarding this case.

A document (Doc 24) was "Filed & Entered" on October 6, 2010 entitled "Settlement Conference" which at the time of this post is unviewable.

Interestingly, a Pre-Trial Conference is scheduled for October 26, 2011 at 8:30 a.m. The Trail date was scheduled for December 13, 2011 at 8:30 a.m.

Plaintiffs bring this action against Defendant Carl Summers (“Defendant”) for unlawfully manufacturing, distributing, and otherwise trafficking in devices, components, and technologies intended to facilitate the illegal and unauthorized reception and decryption of DiSH Network’s satellite television programming (“DiSH Network Programming”) and unlawfully circumventing and facilitating others to circumvent Plaintiffs’ technological measures that effectively control access to DiSH Network Programming.

Defendant is involved in and/or responsible for designing, developing, distributing, trafficking-in, and promoting Pirate Software for various brands of satellite receivers and “Dongles” and/or components thereof, and other circumvention devices and/or components thereof including middleman boards and IKS Servers (collectively “Pirate Accessories”). The Pirate Software and Pirate Accessories are (a) primarily designed or produced for the purpose of circumventing Plaintiffs’ Security System to gain access to DiSH Network Programming; (b) have only limited commercially significant purpose or use other than to circumvent Plaintiffs’ Security System to gain access to DiSH Network Programming; or © are marketed by Defendant and/or others acting in concert with Defendant for use in circumventing Plaintiffs’ Security System to gain access to DiSH Network Programming.
